Terms & Conditions
Please read these terms and conditions carefully before using our HIAB hire or haulage services.
These Terms and Conditions govern the provision of HIAB crane hire, transport, haulage and related services by Nortons Hiab Services Limited (Company No. 6140715), trading as hiabtransport.co.uk (“the Company”, “we”, “us”, “our”), registered in England and Wales, with its registered office at Drewett Street, Miles Platting, Manchester M40 8JD.
1. Definitions
“Client” means any person, firm or company placing an order for Services with the Company.
“Services” means HIAB crane hire, haulage, plant transport, container transport, storage, distribution or any other services provided by the Company.
“Order” means a confirmed booking or purchase order for Services.
2. Agreement
By placing an Order, the Client agrees to be bound by these Terms and Conditions. No variation to these Terms shall be binding unless agreed in writing by a director of the Company.
3. Quotations and Pricing
All quotations are provided in good faith and are subject to change. A quotation does not constitute a binding offer. Prices are confirmed at the time the Order is accepted by the Company. Quotations are valid for 30 days unless otherwise stated.
Unless expressly stated otherwise, prices exclude VAT, any applicable congestion charges, ferry or toll costs, and specialist access equipment not included in the standard quotation.
4. Bookings and Cancellations
Orders are accepted subject to vehicle availability. The Company reserves the right to decline any Order.
Cancellations made with less than 24 hours’ notice may be subject to a cancellation charge equivalent to 50% of the agreed hire rate. Cancellations made on the day of the booked job may be charged at the full hire rate. The Company will confirm any cancellation charges in writing.
5. Client Responsibilities
The Client is responsible for ensuring:
- Safe and legal access to the site for HIAB vehicles and associated equipment
- That the ground conditions at the site are suitable for outrigger deployment and vehicle movement
- That all relevant site-specific hazards (overhead cables, underground services etc.) have been identified and communicated to the Company before the job commences
- That all necessary permissions, permits and consents for the work have been obtained
- That a responsible person is present on site throughout the operation
The Company reserves the right to decline to commence or to cease work at any time if, in the opinion of the operator, site conditions present a risk to safety.
6. Health & Safety
All Services are carried out in accordance with applicable health and safety legislation. The Company will provide Risk Assessments and Method Statements (RAMS) on request. All operators hold current CPCS/CITB certification. The Client must ensure their own site safety rules are communicated to the Company’s operators prior to commencement of work.
7. Liability
The Company’s liability for any loss or damage arising from the provision of Services is limited to the value of the relevant Order, except in cases of death or personal injury caused by the Company’s negligence.
The Company shall not be liable for any indirect, consequential or economic loss howsoever arising. The Company shall not be liable for delays or failures caused by circumstances beyond its reasonable control, including but not limited to traffic conditions, adverse weather, mechanical breakdown or third-party delays.
The Client is responsible for ensuring adequate insurance cover for any goods, plant or equipment being transported or lifted.
8. Payment
Unless otherwise agreed in writing, payment is due within 30 days of invoice date. The Company reserves the right to charge interest on overdue invoices at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
9. Intellectual Property
All content on the hiabtransport.co.uk website, including text, images and design, is the property of Nortons Hiab Services Limited and may not be reproduced without prior written consent.
Disclaimer: Load handling equipment manufacturers and their logos, including HIAB and the HIAB logo, are registered trademarks. HIAB Transport is not associated or affiliated with HIAB or other load handling equipment manufacturers, and expressly disclaims any and all rights to any such marks.
10. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
